How Long Does it Take to Get Divorced in Edmonton?
Most divorces will take between 1 to 3 years after the parties separate.
There are some circumstances which may allow a divorce to take place in less than one year (such as when the grounds for divorce are cruelty or adultery), but for practical purposes most divorces will take at least 1 year after separation.
How Much Does an Uncontested Divorce Cost?
How much an uncontested divorce costs can vary based on whether there is parenting, child support, property division, or spousal support involved.
An uncontested divorce with no children, no spousal support, and no property division can cost as little as $1,000 to $2,000.
An uncontested divorce involving parenting, child support, spousal support, and property division can cost more as the parties will typically require a Separation Agreement and a detailed Divorce Judgment to reflect the terms of their agreement.
What Financial Disclosure Has to Be Exchanged in a Divorce?
The initial disclosure that parties exchange in the case of a divorce is set out in the Notice to Disclose Desk Application which can be obtained on the Alberta Courts website.
There may be additional disclosure required depending on the parties circumstances. In many cases the Notice to Disclose Desk Application is just the starting point.
How Can I Reduce the Cost of My Divorce?
The cost of a divorce is not entirely under your control. If your spouse or their lawyer is being unreasonable, this can increase the cost of the divorce.
In terms of what is under your control, typically a divorce will cost less if a party is willing to voluntarily provide financial disclosure and make reasonable concessions on the issues rather than fighting out of principle for a position that is unlikely to succeed in court.
Do I Need a Divorce Lawyer For My Divorce?
Although not required, it is always recommended to have a divorce lawyer representing you in your divorce. Having a divorce lawyer allows you to understand what you are entitled to, what is fair, and what your options are regarding litigation.
How Do I Get a Certificate of Divorce?
After the Divorce Judgment has been granted and after the 30 day appeal period has passed then the Certificate of Divorce can be requested online from the Alberta Courts website at https://albertacourts.ca/kb/areas-of-law/family/divorce-forms/certificate-of-divorce—request-form or in person by attending at the courthouse.
In some cases the 30 day appeal period is waived and in those circumstances the Certificate of Divorce can be obtained immediately after the Divorce judgment is granted.
