Property division can be complex, especially when businesses or farms are involved. We have family law lawyers who can explain the complexities of property division to you in simple, easy to understand terms.
SPOUSAL SUPPORT
Spousal support (or adult interdependent partner support) are payments made by one spouse or adult interdependent partner to the other either on a lump sum or periodic basis. There are three grounds for spousal or adult interdependent partner support: compensatory, non-compensatory, and contractual.
CHILD CUSTODY & ACCESS
When considering an application in relation to parenting, the only thing the court is allowed to consider is the best interests of the child. Our goal is to help you and your spouse resolve your differences and minimize the impact on your children.
CHILD SUPPORT
Child support is the right of the child. The child support provisions of the Divorce Act and Family Law Act apply to children under the age of 18, and in some cases those who are older. Our lawyers can help you determine the amount of child support your children should be receiving.
FAMILY AGREEMENTS
Family agreements include, but are not limited to, cohabitation, pre-nuptial, post-nuptial, and separation agreements. The law in Alberta gives the parties’ discretion to resolve most family law issues by agreement. Our lawyers can give you advice on your agreement, draft your agreement for you, or provide you independent legal advice for your agreement.
NEGOTIATION AND MEDIATION
Litigation is expensive and when you litigate you are leaving the decision to a judge who knows nothing about your family. Whenever possible it is preferable to negotiate with the other part, or if that fails, to attend mediation. Our lawyers can negotiate on your behalf or attend mediation with you so that your interests are protected.
FAMILY VIOLENCE
Family violence is a serious issue impacting many families. The law is increasingly recognizing the importance of considering family violence when it is relevant to the parenting of the children. Our lawyers can represent you in relation to Emergency Protection Order (EPO), Restraining Order, or exclusive possession of the home matters before the court.
