What is a Postnuptial Agreement?
A postnuptial agreement is a legally enforceable contract between two people defining their rights and obligations, including in relation to spousal support and property division. By definition, a “postnuptial” agreement is entered by two parties after they have already been married.
In many cases the parties intended to sign a prenuptial agreement, but did not have enough time, so opted for a postnuptial agreement instead.
As a postnuptial agreement defines parties rights and obligations, including upon separation, in many cases it eliminates the need for a separation agreement should the parties separate.
For those who are not married and do not intend to get married, but are already in an adult interdependent partnership, a cohabitation agreement can be entered instead of a postnuptial agreement.
What is Included in a Postnuptial Agreement?
A postnuptial agreement is a contract and accordingly the parties have flexibility as to what is included within it. Postnuptial agreements commonly include terms related to:
- Property Division: Postnuptial agreements typically define who will retain each asset and liability during the marriage and after the separation should the parties separate.
- Spousal Support: Some postnuptial agreements may include waivers of spousal support others clearly define the amount of spousal support payable should the parties separate.
- Possession of Homes: If one or both parties own a house, postnuptial agreements may define who gets to keep the home in the case of separation.
- Terms Related to Estates: Postnuptial agreements frequently involve waivers of an interest in the estate of the other except as set out in the parties respective wills.
